These Terms and Conditions (“Terms”) govern access to and use of the website Kulski.com (the “Site”) and the purchase of products offered through the Site.
By accessing the Site or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Site.
These Terms comply with applicable European Union legislation, including:
- Directive 2011/83/EU on Consumer Rights
- Directive 2005/29/EC on Unfair Commercial Practices
- Directive 93/13/EEC on Unfair Terms in Consumer Contracts
- Regulation (EU) 2016/679 (GDPR)
- Slovenian Consumer Protection Act (ZVPot-1) and related legislation

2. Scope of Application
These Terms apply to all contracts concluded between Kulski and customers located within the European Union.
A “consumer” is any natural person acting for purposes outside their trade, business or profession (Article 2(1) Directive 2011/83/EU). Certain rights described herein apply only to consumers.
3. Eligibility
You must:
- Be at least 18 years of age;
- Have legal capacity to enter into binding contracts;
- Provide accurate and complete information when placing an order.
4. Conclusion of Contract
- Product listings on the Site constitute an invitation to treat, not a binding offer.
- By placing an order, you submit a binding offer to purchase the selected products.
- The contract is concluded only when we send an order confirmation email explicitly accepting your order.
- We reserve the right to refuse or cancel orders for legitimate reasons (e.g., pricing errors, suspected fraud, stock unavailability).
The contract language is English unless otherwise stated.
5. Products and Availability
- Products are described as accurately as reasonably possible.
- Minor deviations in color, packaging, or design may occur.
- Product images are illustrative.
Where products are supplied by third-party manufacturers, Kulski acts as retailer. Nothing in these Terms limits mandatory statutory rights regarding product conformity.
6. Prices and Taxes
- All prices are displayed in EUR unless otherwise stated.
- Prices include VAT where applicable, in accordance with EU VAT rules.
- Shipping costs are displayed separately before checkout.
We reserve the right to correct obvious pricing errors prior to contract conclusion.
7. Payment
Payment is due at the time of order.
Accepted payment methods are displayed at checkout. By submitting payment details, you confirm you are authorized to use the selected payment method.
If payment fails or is reversed, we may suspend or cancel the order.
8. Delivery
- We deliver within the European Union.
- Estimated delivery times are provided for information purposes only.
- Risk transfers to the consumer upon physical possession of the goods (Article 20 Directive 2011/83/EU).
We are not liable for delays caused by force majeure events beyond our reasonable control (e.g., natural disasters, customs delays, strikes).
9. Right of Withdrawal (EU Consumers)
If you are a consumer residing in the EU, you have the right to withdraw from the contract within 14 days without giving any reason (Article 9 Directive 2011/83/EU).
Withdrawal Period
The withdrawal period expires 14 days after:
- You acquire physical possession of the goods; or
- A third party indicated by you acquires possession.

To exercise the right of withdrawal, you must inform us by clear statement (e.g., email).

You may use the EU model withdrawal form but it is not mandatory.
Effects of Withdrawal
- We will reimburse all payments received, including standard delivery costs.
- Reimbursement will be made within 14 days of receiving the returned goods or proof of return.
- Refunds will be made using the same payment method unless otherwise agreed.
You must return goods within 14 days of withdrawal.
You are responsible for return shipping costs unless otherwise stated.
Exceptions
The right of withdrawal does not apply to:
- Sealed goods unsealed after delivery and not suitable for return due to hygiene reasons;
- Custom-made or personalized goods;
- Digital content supplied electronically after performance has begun with prior consent.
10. Legal Guarantee of Conformity
Consumers are entitled to a legal guarantee of conformity under Directive (EU) 2019/771.
We are liable for any lack of conformity existing at the time of delivery and becoming apparent within:
- 2 years from delivery (minimum EU standard).
If goods are defective or not as described, you are entitled to:
- Repair or replacement;
- Price reduction; or
- Termination of contract (where legally justified).
These statutory rights cannot be excluded or limited.
11. Limitation of Liability
Nothing in these Terms excludes or limits liability for:
- Death or personal injury caused by negligence;
- Fraud or fraudulent misrepresentation;
- Mandatory consumer rights under EU law.
Subject to the above:
- Kulski is liable only for foreseeable damages resulting from breach of contract.
- For slight negligence, liability is limited to typical and foreseeable damages.
- Total liability shall not exceed the total purchase price of the relevant order, unless mandatory law provides otherwise.
12. Intellectual Property
The Site and its content (text, graphics, logos, layout, software) are protected by copyright and intellectual property laws.
You may not:
- Copy, reproduce, distribute, or exploit Site content for commercial purposes without written consent.
All third-party trademarks remain property of their respective owners.
13. Prohibited Use
You agree not to:
- Use the Site for unlawful purposes;
- Attempt unauthorized access to systems;
- Distribute malware;
- Infringe intellectual property rights;
- Engage in abusive or fraudulent behavior.
We may suspend or terminate access in case of violation.
14. Data Protection
Processing of personal data is governed by our Privacy Policy and complies with GDPR.
15. Alternative Dispute Resolution (ADR) and ODR
In accordance with EU Regulation No 524/2013, consumers may use the European Commission’s Online Dispute Resolution platform:

We are not obliged to participate in alternative dispute resolution before a specific ADR body unless required by law.
16. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Slovenia.
For consumers:
- You may bring proceedings in the courts of your place of residence within the EU.
- Mandatory consumer protection provisions of your country of residence remain applicable (Article 6 Rome I Regulation).
For non-consumer disputes, exclusive jurisdiction lies with the competent court in Slovenia.
17. Amendments
We may amend these Terms for legal or operational reasons. The applicable version is the one in force at the time of order.
18. Severability
If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect.
